Terms & Conditions for GuestsWe are Nearly Married Limited, a company incorporated under the laws of Scotland, with company number SC294482 and a registered office at George House, 36 North Hanover Street, Glasgow G1 2AD. In these Terms and Conditions Nearly Married Limited is referred to as "we", "us" or "our".These Terms and Conditions apply to any gift ("Gift") given over our website at www.nearlymarried.co.uk (our "Website") or by telephone by wedding guests, friends or relatives ("Guests") to any couple (the "Couple") that are due to be married or are due to enter into a civil partnership and who have registered their wedding gift list (the "Gift List") with us. If a Guest uses our Website to make a Gift to the Couple, or gives payment details to us over the telephone for the purposes of making a Gift, then the Guest hereby agrees to be bound by these Terms and Conditions. We recommend that you print these Terms and Conditions off or save them to your computer so that you have a copy of them for future reference. Please note that a Guest must be over 18 years of age to use our Website to purchase a Gift over our Website.
How our service works
Guests can use our Website or our telephone line on 0845 257 8529 (calls are charged at local rate wherever you are) to give a Gift to the Couple. Please note calls may be recorded for quality monitoring and training purposes. We will hold the value of the Guest's Gift in trust for the Couple, and we will use that money to purchase the relevant goods from our suppliers, or where we are instructed to do so by the Couple we may use the Gift to buy alternative goods chosen by the Couple (usually this will happen if the goods in question are no longer available). We will also charge a small administration fee (the "Administration Fee") of £3.50 in respect of any Gift or purchase (irrespective of the number of items included) to cover administration and delivery costs. Where the Guest chooses to give a gift of money this may be subject to a Money Fee which will be shown in the gift description if it applies. The maximum Money Fee is 8%. The Administration Fee and / or Money Fee will be clearly stated before the confirmation of the Gift order. We accept all major credit and debit cards (Switch, Maestro, Visa Debit, Visa Credit, Mastercard and Electron) for Gifts over our Website or by telephone. Please note we do not accept payment by Diners Card or American Express. By submitting card details to us by telephone or over our Website the Guest agrees to authorise us to debit or charge the value of the Gift and the Administration Fee (including VAT and any other applicable taxes and charges) from the Guest's credit card, debit card or bank account. All payments are handled securely. Once we have received payment in full from the Guest we will inform the Couple that the Guest has given the Couple a Gift, and we will tell the Couple what Gift was selected from the Gift List. We will wait for the Couple to instruct us to purchase goods from our suppliers using the money the Guest has given as a Gift. Please note that we act at all times as the agent of the Couple when making purchases of goods. This means that the Couple has the added flexibility and comfort of being able to substitute goods in circumstances where goods are no longer available. The Couple can alter the Gift List at any time and the Guest hereby agrees that, provided that the Couple instructs us to do so, we are entitled to use the Guest's Gift to purchase other goods than the goods the Guest originally chose from the Gift List.

Use of Personal Information
General
We shall not be liable for any delay, loss or damage caused to Guests due to circumstances beyond our reasonable control including, without limitation, the cancellation of the Couple's wedding, acts of God, governmental actions, war or national emergency, riot, civil commotion, fire, explosion, flood, epidemic, lock-outs, strikes or other labour disputes. Our entire liability to the Guest in respect of any loss or damage arising from any breach of our contractual obligations under these Terms and Conditions or for any representation, statement, tortuous or delictual act including negligence shall be limited to the value of the Guest's Gift. We shall not be liable for any indirect, special or consequential loss whatsoever and howsoever suffered by the Guest whether or not caused by or resulting from our negligence or the negligence of our employees, agents, suppliers, representatives or resulting from any breach of our statutory duties or any breach of our obligations under these Terms and Conditions. Nothing in these Terms and Conditions shall limit our liability for death or personal injury caused by our negligence or for any other liability which cannot be excluded by law.
